myHR Modules and Release Notes

TERMS OF USE, WARRANTY & LIABILITY WAIVER

This disclaimer ("Disclaimer") sets forth the general guidelines, disclosures, and terms of your use of the "myHR Modules and Product Release Notes" ("myHR" or "Release Notes" or "Modules"). This Disclaimer is a legally binding agreement between you ("User", "you" or "your") and Titanium Technologies ("Creator", "we", "us" or "our"). 

Terms of Use

The Modules along with their Release Notes are offered to you conditioned upon your acceptance without modification of the terms, conditions and notices obtained. By accessing and using the Modules, you acknowledge that you have read, understood, and agree to be bound by the terms of this Disclaimer. If you are entering into this Disclaimer on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Disclaimer, in which case the terms "User", "you" or "your" shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Disclaimer, you must not accept this Disclaimer and may not access and use the Modules. You acknowledge that this Disclaimer is a contract between you and the Creator, even though it is electronic and is not physically signed by you, and it governs your use of the Modules. 

Use Limitation

No part or parts of the Module or any of Titanium Technologies’ materials may be reproduced, reverse engineered, decompiled, disassembled, separated, altered, distributed, republished, displayed, broadcast, hyperlinked, mirrored, framed, transferred or transmitted in any manner or by any means stored in an information retrieval system or installed on any servers, system or equipment without Titanium Technologies’ prior written permission or that of the relevant copyright owners. 

Modular Enhancements and Upgrades

All of Titanium Technologies’ modular enhancements and system upgrades are quality checked and tested prior to deployment. Our software products are designed for the sole purpose agreed in the subscription contract between you and Titanium Technologies. The product is not intended for third-party modification, external-initiated customization, unauthorized manual interference; due to the risk of hardware and/or software malfunction.

Warranty

The accuracy, reliability, and completeness of the information and content, distributed through, linked, downloaded, or accessed from the Modules are guaranteed by the Creator. However, all information in the Release Notes is provided "as is", with no guarantee of the results obtained from the use of this information, and without warranty of any kind, express or implied. In no event will the Creator, or its partners, employees or agents, be liable to you or anyone else for any decision made or action taken in reliance on the information in the Release Notes, or for any consequential, special, or similar damages, even if advised of the possibility of such damages. Information in the Release Notes is for general information purposes only and is not intended to provide any type of professional advice. Titanium Technologies shall not be held liable in case the product is used in any other manner different from the purpose for which it was created.

Product Release Applicability

Published product release notes are categorized according to their affiliated modules and are applicable to subscriptions that have the corresponding modules. If your current subscription does not involve or include the stated modules, it is recommended to disregard those particular product release notes as they will be irrelevant in such a case.

Entire Obligation

The TERM OF USE, WARRANTY, AND DISCLAIMER document states the entire obligation of 

Titanium Technologies with respect to the products. 

In the event that any term or condition of this agreement is in conflict with or is otherwise unenforceable under any law, rule or regulation of the government or any subdivision thereof, such term or condition shall be deemed stricken from this agreement, but such invalidity or unenforceability shall not invalidate or render unenforceable the remainder of this Agreement.

General

This disclaimer shall be governed by and construed in accordance with Philippine law. If any dispute relating to the use of the product, system, and this module arises, the Parties shall attempt, in fair dealing and in good faith, to settle such dispute. Use of this product is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.

Modification of Terms and Conditions

Titanium Technologies reserves the right to change the terms, conditions, and notices under which their products are offered. Additionally, Titanium Technologies reserves the right to revise these guidelines, notices, operating rules and policies and instructions at any time and you are deemed to be aware of and bound by any changes to the foregoing upon notice.
